The sale of items via the website www.lattebabyandchild.com is subject to the following conditions:

Seller

Items referred to in these general conditions are placed on sale by Nero srl, owner of the LATTE Baby and Child trademark based in Perugia, via Lenin n. 2/A, Corciano, 06073, Perugia Business Registry no. PG – 293475, Tax identification and VAT no. 03497890545.

Purchaser

Any natural person of age can order items listed in the online catalogue.
Under all circumstances the purchaser is required to provide their own personal and fiscal data to LATTE Baby and Child, under their sole liability for false or incomplete declarations thereof.

Purchase offer

Publication on the website www.lattebabyandchild.com of single products, with relative description and price, solely and exclusively  constitutes an invitation to offer.
The purchaser may order garments published in the online catalogue by carrying out operations requested during the purchasing procedure and registering on the website or by following operations as a non-registered user.
Once the operation is successfully completed, a notice confirming your order has been sent will appear on the screen.

Conclusion of the contract

Upon receiving the order, LATTE Baby and Child will notify the user whether the received order is fully or partially accepted or otherwise, in an email sent to the address entered in the order form.
In any case, the contract will only be concluded when the purchaser receives confirmation that the order has been accepted by LATTE Baby and Child.

Partial acceptance of order

If LATTE Baby and Child is able to partially accept the order only, due to  stock unavailability or for any other reasons, the purchaser will be informed upon order confirmation.
Unless notification to the contrary is sent by the purchaser within 14 days from reception of order confirmation, the contract will be considered concluded as regards the sale of items specified in the order confirmation and LATTE Baby and Child will refund the price of other goods.

Sending order confirmation

The purchaser will receive all information regarding the order and contract via email. Said information will also be stored in the LATTE Baby and Childdatabase.In case of non-delivery or accidental loss, the purchaser can send a request by writing to info@lattebabyandchild.com.

Delivery times

Goods will be shipped by LATTE Baby and Child via SDA or BRT Corriere Espresso to the purchaser no later than three days than the day after order transmission (excluding Sundays and holidays).
Pursuant to point 8, the delivery date will depend on the date on which any replacements or changes to the order are agreed to.

Amendments to the Contract

Any changes to the number of goods specified, size, colour and any other contractual elements must be agreed by both parties.
To this effect, the purchaser must contact LATTE Baby and Child by sending an email to info@lattebabyandchild.com, or a registered letter with return receipt toLATTE Baby and Child based in Perugia, via Lenin n. 2/A, Corciano, 06073.

Price

The price must be paid upon sending the order. LATTE Baby and Child will not process any orders without receiving full prior order payment including the price of ordered goods, shipment and any other costs.

Shipment

As specified in the order form, the purchaser will bear all shipment costs.
The purchaser will also bear all risks of loss and/or damage of goods once dispatched from LATTE Baby and Child.

Right of withdrawal

The purchaser can withdraw from the contract within 14 from the reception of goods, pursuant to articles 55 and 64 et seq. of Italian Legislative Decree no.206, 6th September 2005 (“Consumer Code”).

Exercising your right of withdrawal

Any purchaser who wishes to withdraw from the contract must send notification to this effect in a registered letter with return receipt toLATTE Baby and Child based in Perugia, via Lenin n. 2/A, Corciano, 06073 and return goods within 10 days from date of delivery.
Goods returned to LATTE Baby and Child must be intact, complete with any accessories, with labelling and original packaging. Therefore, requests for withdrawal will be rejected if garments are damaged or used, or present labelling that has been altered or removed, or in any case, if garments are not in the same condition as they were upon delivery to the purchaser.
Expenses incurred for returning goods to LATTE Baby and Child will in any case be borne solely by the purchaser.

Price refund

Whenever the right of withdrawal is legitimately exercised, LATTE Baby and Child will provide the purchaser with a full refund of supplied goods, excluding any shipment and any other additional costs incurred, within 30 days from the reception of goods.
Nothing will be due if the right of withdrawal is exercised after the deadline specified under point 11, or in the event that goods are not returned in compliance with conditions specified under point 12.

Partial withdrawal

The purchaser may also exercise their right of withdrawal for a part of ordered goods.
In this case, the purchaser must specify single items for which they intend to exercise their right of withdrawal in the withdrawal declaration and return them to LATTE Baby and Child.
LATTE Baby and Child will then refund the price of returned goods only.

Complaints

Please send any complaints in a registered letter with return receipt to LATTE Baby and Child based in Perugia, via Lenin no. 2/A, Corciano, 06073.

Mediation

Any disputes which may arise between the seller and purchases can be defined according to mediation procedures set forth in the Consumer Code (Italian Legislative Decree 206/2005).

Customer Care

Prior to or following the conclusion or execution of the contract, the purchaser may submit any requests for assistance to LATTE Baby and Child by sending an email to info@lattebabyandchild.com or a registered letter with return receipt to LATTE Baby and Child based in Perugia, via Lenin no. 2/A, Corciano, 06073.

Purchaser’s rights

Whenever and in their capacity as a consumer, pursuant to Italian Legislative Decree 206/2005, the purchaser may avail themselves of the rights set forth in chapter I, sec. II of Legislative Decree. 206/2005.

Account protection

The purchaser must not disclose their login details and password and in general should take all necessary precautions to prevent any unauthorised access to the website via their account. If this secret is breached, the purchaser is required to informLATTE Baby and Childimmediately.
In any case, the purchaser is liable for all activities carried out using their account and password, including those by unauthorised third parties.

Privacy

Upon sending the order, the purchaser authorises LATTE Baby and Child to process their personal data, for purposes strictly necessary for processing the order and entering the sale in accounting records. The purchaser may correct any erroneous information entered and change their personal data by logging into the website
